The Ombudsman found that the City of Sault Ste. Marie Cultural Vitality Committee’s resolution to proceed in camera was sufficiently descriptive to provide information to the public without undermining the reason for excluding the public.
The Ombudsman found that the City of Sault Ste. Marie’s Cultural Vitality Committee contravened the Municipal Act, 2001 on November 17, 2021, by holding a meeting that did not comply with the open meeting requirements. The Ombudsman found that the meeting was not open to the public, as the Committee did not provide the public with information about how to attend the virtual meeting. The Ombudsman also found that the City of Sault Ste. Marie’s Tourism Board contravened the Municipal Act, 2001 on November 25, 2021 by holding a meeting that did not comply with the open meeting requirements. The meeting was not open to the public, as the Board did not provide the public with information on how to attend the virtual meeting.
The Ombudsman reviewed a closed meeting held by council for the City of Sault Ste. Marie. During the meeting, council voted to direct the Mayor to continue negotiations related to the acquisition of land. The Ombudsman found that the vote was permissible as it was a direction to an officer of the municipality related to council’s in camera discussion.

The Ombudsman found that other topics covered in the presentation, such as risk management, effect on service levels, and financial savings generally do not fit within the labour relations or employee negotiations exception. However, the Ombudsman found that those topics were not discrete and were included to inform council’s discussion about labour relations and were not required to be parsed from the discussion. Therefore, council’s discussion fit within the labour relations or employee negotiations exception.
