The Ombudsman received a complaint about a special meeting held by the Municipality of Lambton Shores on April 15, 2019. The complaint alleged the public did not receive notice for the special meeting held by council at 12:00 p.m. The municipality posted the public notice for the special meeting on April 14 at 6:40 p.m. on the municipality’s website, in accordance with its procedure by-law. The municipality’s procedure by-law allowed for public notice of special meetings to be provided “as soon as practical.” The Ombudsman provided best practice suggestions related to the procedure by-law and requiring a public notice period for special meetings.

The Ombudsman received a complaint about a gathering that two council members attended on April 14, 2019. Council for Lambton Shores is composed of nine council members. The new definition of "meeting" in the Municipal Act, 2001 requires that a quorum of members be physically present in order for a gathering to be subject to open meeting requirements.

The Ombudsman reviewed a closed meeting held by council for the Municipality of Lambton Shores. The meeting was closed under the personal matters exception. While in camera, council conducted six votes. The Ombudsman found that the meeting fit within the cited exception. However, the Ombudsman also found that the votes were not for procedural matters or for directions to staff and were therefore improper.

The Ombudsman reviewed a closed meeting held by council for the Municipality of Lambton Shores to discuss the performance of an identifiable member of staff. The meeting relied on the personal matters exception. The discussion included an examination of the employee’s job performance, as well as personal views and opinions expressed about this individual. The Ombudsman found that the information discussed qualified as personal information. Therefore, the discussion fit within the personal matters exception.
