The Ombudsman found that Council's July 23, 2013 closed meeting with its Solicitor to receive advice about litigation filed against the Town in relation to a building permit/development dispute, was permitted under both the "solicitor client privilege" and "litigation or potential litigation" exceptions to the open meeting requirements.

The Ombudsman found that Council's July 23, 2013 closed meeting with its Solicitor to receive advice about litigation filed against the Town in relation to a building permit/development dispute was permitted under both the "solicitor client privilege" and "litigation or potential litigation" exceptions to the open meeting requirements. However, the Ombudsman noted that Council did not state the general nature of the matter to be considered in closed session as required under the Act, and the Town's Procedure By-Law did not specifically provide for public notice of special meetings.
